A former Fox News employee plans to tell Congress about allegations the outlet tried to prevent her from reporting on Stormy Daniel's controversy during the 201
On Thursday, Elijah Cummings, chairman of the house monitoring committee, formally requested the reporter Diana Falzone, talk to the committee investigator and send documents related to her attempt to report on Daniel's claims that Michael Cohen, former Donald Trump's former lawyer, paid his house money after an alleged deal with Trump 2006.
Falzon's lawyer, Nancy Erika Smith, told MSNBC on Thursday night that Falzone will now follow an exception to her NDA with Fox News.
"The law requires you to participate in any government appreciation – and no NDA can stop it," says Smith at "The Beat with Ari Melber." "to silence women who claimed extraterrestrial affairs with him before the presidential election in 2016" and "any action against [Falzone] in connection with attempts to report such stories. "New Yorker reported in March that Fox News prevented Falzone from reporting on Daniel's accusations during the election to protect Trump, which Fox denies. A former Fox News executive also claims that the story was explained because it was not journalistically ready, not on Because of any political agenda.
In his MSNBC interview, Smith specifically rejected that account, calling it a "lie" and said the executive was not the person who prevented Falzons history from being published.
"We'll see what the evidence shows about how Fox responded to this story, "she had the amount, she had the company name that the original deal was," she had the amount, she had the company names that the original deal is called, she had the date of business, "she said. Davidson, "and she asked me to confirm these details. "
The letter from Cummings comes days after Smith publicly suggested that Congress could help her client speak by giving a legal final run around her NDA with Fox N ews.
" Maybe Congress should bring my client and all his document, "Smith said in an MSNBC interview" and then we will see exactly what Fox News had. "
Many NDA agreements contain provisions that are broadly public but still provide exemptions to follow criminal and public Falzone has not released the text in its NDA.
Many legal experts say that a legitimate congressional request overrides a typical NDA, and even if an NDA tried to obtain such co-operation, it is unlikely that courts will punish anyone for responding to a valid investigation for information
University of Florida, Professor Mark Fenster, an openness expert, says that courts typically lay aside an NDA when a erson "responds to a properly issued Congress Court".
Orly Lobel, a labor law expert at the University of San Diego School of Law, said that Falzone could "tell his story" without worrying if she responded to a legal congressional inquiry, as this is a matter of public interest .
Fox News did not immediately respond to a request for comment on Cumming's request.
Other members of Congress have also considered the issue.
Rep. Ted Lieu, D-Calif., Sitting in the House Judiciary Committee, tweeted about his willingness to use the formal congressional request to free people who "feel silent" from talking about the Trump administration.
